1. OBLIGATIONS PRIOR TO THE START OF THE SALE PROCEDURE
This document (together with all documents indicated therein and also available on the website) sets out the terms and conditions governing the sale of products and provision of services (hereinafter referred to as the 'General Sales Conditions') through the website www.viladomat.com (hereinafter the 'WebSite' or the 'Web Page').
When you place an order through the Website the Buyer agrees to be bound by these General Sales Conditions, the Conditions of Use of the Website and our Privacy Policy and Cookies Policy (hereinafter collectively referred to as the 'Terms and Conditions'). Therefore, if the customer does not agree with all of the Conditions and Policies, they should not purchase through this Webpage.
It is expressly stated for the record that the Terms and Conditions have been drafted by PIRINEU PORT, S.L. and VILADOMAT, S.A.U. in accordance with the applicable regulations, in particular, in accordance with the provisions of (i) Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, (ii) European Regulation 679/2016 on the Protection of Personal Data, (iii) Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, (iv) Andorran Law 29/2021, of 28 October, (v) Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, (vi) Law 7/1998, of 13 April, on General Contracting Conditions, Law 13/2013 of 13 June on effective competition and consumer protection, as well as any other applicable law.
The Terms and Conditions may be modified at any time, and it is the Buyer's responsibility to review them periodically, as well as each time he/she proceeds with the purchase of products and/or services. The Terms and Conditions in force at the time of use of the Website or conclusion of the Contract (as defined below) will apply to the Contract.
The Terms and Conditions have been originally written in Spanish and the user agrees that the Spanish version of them shall prevail over any version in another language.
2. IDENTIFYING DATA
- On one hand, PIRINEU PORT S.L., with its corporate headquarters located in Poligon Industrial E-32 - 25700 La Seu de Urgell, Lleida (SPAIN) with tax ID B-25.513.326, e-mail: viladomat@viladomat.com, as the seller of the products and services that are offered through this Website, also being a subsidiary of the company VILADOMAT, S.A.U.
- On the other hand, by VILADOMAT, S.A.U., with its corporate headquarters located at C/ Esteve Dolsa Pujal, 30 AD500 Andorra la Vella (Principality of Andorra) with tax ID A-700966-G, e-mail: viladomat@viladomat.com, as the owner of the Website and, in turn, the service provider and seller of the products offered through this Website, corresponding to the services provided in Andorra [Andorran citizens Click & Collect sales and rentals] and outside the EU. Hereinafter, the companies PIRINEU PORT, S.L. and VILADOMAT, S.A.U. will be referred to as 'the Company' indistinctly. Together, they will be called 'the Group Companies'.
- And, on the other hand, any person who acquires any of the products or services offered on the Webpage. (Hereinafter referred to as the 'Buyer' or the 'Buyers').
The parties agree that their relations will be governed exclusively by these General Sales Conditions, which are accessible on the Webpage and which must be, in any case, previously accepted by the customer. In case of modification thereof by the Company, the conditions to be applied to each Buyer will always be those accepted at the time their purchase is made. The Buyer, prior to the Sale and, during the purchase process, can access, file and print these General Sales Conditions for its consultation.
3. PURPOSE OF THE CONTRACT
The Company offers through the Parent Company's Website:
- On one hand, the sale of a wide range of sports-related products which will be included in the product detail page offered at any time through the Website.
- On the other hand, the Company's Website provides a service for the reservation and rental of sports equipment, for its subsequent collection at any of the available stores previously indicated by the Buyer.
For these purposes, the selling of products and/or services through the Website is intended exclusively for end consumers, in accordance with the provisions of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws (hereinafter, the "TRLGDCU").
The present conditions, therefore, aim to regulate the commercial relations arising between the Company and the Buyers through the Website.
4. PURCHASE REQUEST / ONLINE RESERVATION
The Buyer declares to be of legal age and to have the legal capacity to make a purchase on the Webpage. The Buyer agrees to respect these General Sales Conditions.
The purchase through the Website is available for shipping addresses in Countries of the European Union as well as European Countries that are not part of it. For other Countries, the customer must contact us through viladomat@viladomat.com or through the form that may be found by clicking in the “Help Center” before completing any order. If a purchase cannot be sent to these destinations, and the payment was correctly made, the Buyer will be notified by e-mail and/or telephone and the amount paid will immediately be credited.
The purchase through the Webpage is also available for Buyers who wish to pick up their purchase at one of our stores by choosing the ‘Click & Collect option’.
Online purchase of an item/service can be done by following these steps:
- The Buyer must access www.viladomat.com and connect to the store:
- The Buyer has several possibilities to find an item. In this way, the Buyer can visit a certain sports section or search for the type of product by using the menu that can be found at the top of the page in case he/she is accessing through a computer (desktop version), at the bottom of the Website in case he/she is accessing through a mobile phone (mobile version) or, if necessary, by using the search engine provided for that purpose on the Webpage.
- Once the Buyer has found the product he/she wants, he/she must 'click' on the image to discover the product in detail and view its details. Once he/she is on the product page of his/her choice, the Buyer must select the size and model of the product (in case there are variants). The Company shall ensure that the images of the products displayed on the Website clearly identify the products and services offered but cannot be liable for how they may be interpreted by the Buyer. The Buyer must consider that the image of the products, the name of the same, as well as their description, can be clearly and understandably displayed on the Website for the Buyer. In any case, the Group Companies shall not be liable for any changes to the products that the manufacturer does not notify to the Company and that may affect the image, name or description published on the Website.
- The Buyer who has selected a product will be able to see the selected product on the screen, together with its description, information and price. On this same screen, at the bottom, the Buyer is provided with a form to contact the Company if he/she has any doubts regarding the product. To send the form, the Buyer must enter their name, first surname, a valid e-mail address and the comment or query they wish to send to the Company.
- If the Buyer wishes to continue shopping and/or browsing the online shop, he/she must close the window by clicking on the "X" and then click on the arrow that allows him/her to go "back" to continue viewing the products.
- If the Buyer wishes to add the product to the cart, he/she must click on the 'Add to cart' button. The Buyer will see on the screen the product/s in the cart and will be able to change the quantity of the product/s in the cart or remove it from the cart. If the Buyer wishes to complete the purchase and confirm the order, he/she will have to click on the button ‘Proceed to checkout’. On the next screen the Buyer will have to identify himself. If you are a previously registered Buyer, you will only have to enter your email and password, as your personal details will already be registered in our database. If you are a new Buyer, you must click on the "New Customer" option and fill in the boxes with your personal details (email, password, name, surname, address, postcode, city, country and a telephone number). The Buyer must then indicate the method of payment. Once the order has been placed, you will receive a summary of the order by email.
- The Buyer will also have the option to click on the 'Click & Collect' button (Collect in shop) (Store Pickup) with the available payment methods and, in this case, will have to collect the purchased product in one of the Company's physical shops.
- The shopping cart:
- The Buyer shall be able to view the content of the shopping cart by clicking on the shopping cart icon at the top right-hand side of the Website and then clicking on the `Proceed to Checkout' button, either in the 'Delivery at home' or 'Click & Collect' (Store Pickup) options.
- In the shopping cart the Buyer will be able to view the products added to the online shop and will be able to change the quantity of any product or remove it. The price will be updated accordingly. Likewise, the Buyer will be able to see the reference number of the product and in the event that there is a discount on it, he will see it reflected, since the initial price appears in red and strikethrough together with the new price. At the end of the shopping cart, the total number of products selected is shown together with the total price. If you wish to complete the purchase, you must click on the 'Proceed to checkout' button.
- The Buyer is warned that adding a product to the cart does not guarantee the reservation of the same. It may happen that another customer buys the same product while the Buyer is browsing the Website. In the event that the item disappears from the cart, it will mean that it is no longer available. Once the payment of the order has been completed, the product will be reserved for the Buyer.
- Product price may vary depending on whether the products are discounted or promoted.
- Price:
- The price of the items added and displayed in the cart will be subject at all times to the prices published in the country where the Buyer views the webpage or depending on the country chosen through the country selector (located at the top right). It should be kept in mind that prices may vary if the Buyer uses an intermediary computer network in the resource requests from the client to the server.
- However, if the Buyer has selected the 'Click & Collect (Store Pickup)' option, the prices published will be those of the stores of the Parent company in Andorra, exempt of foreign taxes.
- Deliver method:
- The Buyer must choose how he would like to receive/pick up their order in the cart. There are two options:
- 'Click&Collect' (Store Pickup) button: Pick-up option for the purchase at any of the Parent company's stores in Andorra.
- 'Delivery at home': This is the home delivery option. With this option, the order will be delivered to the address associated with the account of the Buyer and/or the information provided.
- Log in:
- If the Buyer is a registered user, they must click on the 'I am already registered' and enter their e-mail address and password.
- If the Buyer is a “New customer” they must enter the indicated personal data in the form.
- In case of selecting the 'Click & Collect' option, the identification of the Buyer is exactly the same as in the above-mentioned points, except that in this case the Buyer must also choose the collection shop and indicate the person who will collect the purchase. The Buyer will be able to collect his order from the indicated shop, within forty-eight (48) hours after the payment has been validated though the method chosen in point 7, in order to guarantee the preparation of the order.
- The store of the Parent company indicated by the Buyer for the collection reserves the right to request the National Identity Document or Passport, Tax Identification Number or, where applicable, passport of the Buyer or person designated for the collection of the purchased product and the email order summary in order to verify their identity.
- Validation of the Cart: Verification of Cart data:
- Delivery Address: When logging in and after clicking the 'Continue' button, the Buyer can view all addresses previously used. One of them will be selected as a favorite, although this may be modified and/or another address may be selected by clicking 'Edit' or 'New Address'.
- If you have not logged in or you are not registered as a customer, complete and carefully review the information in the form.
- Notwithstanding the provisions at the beginning of this third clause, the Buyer shall indicate the country of destination of the order.
- The Buyer may change the delivery address of a product or modify or cancel it as long as it has not left our facilities. To do so, the Buyer must contact us immediately by filling out the form indicated in the 'Help Centre' by clicking on 'Online Shop'. The Buyer must indicate the order number and the new shipping instructions or request its cancellation or modification. In the event that it has been possible to cancel or modify the order, the Company will send a confirmation email to the Buyer.
- If the order has already been shipped, The Buyer cannot change the delivery address of the order.
- Payment method:
- Once the information has been validated, the Buyer must click the 'Continue' button and access the payment method. The company currently provides Buyers with the following payment methods:
- Credit or debit card. For any amount. Only Visa, MasterCard Visa Electron and Maestro cards are accepted.
- Bank transfer. For any amount. Upon completing the purchase, the information will appear to make the transfer. Note that the bank transfer option as payment is not available for the 'Store Pickup' option.
- PAYPAL. For any amount by using the PAYPAL account of the Buyer. Note that this payment method will not be available for any purchase that implies “Store Pickup” as rental services or 'Click & Collect'.
- If the Buyer has chosen in the 'Delivery Method' section the option 'Click & Collect' (Collect in shop)' (Store Pickup), the Buyer has the option of paying twenty percent (20%) of the purchase through the Website as a reservation of the purchase and paying the remaining eighty percent (80%) on collection of the product or one hundred percent (100%) of the purchase at first.
- If The Buyer is satisfied with all the information of his order, he must click on the 'Place Order' button and then click on the square indicating that he accepts the present General Sales Conditions and our Privacy Policy.
- Once the information has been validated, the Buyer must click the 'Continue' button and access the payment method. The company currently provides Buyers with the following payment methods:
- Payment:
- The Buyer will be redirected through a secured connection. All purchases made through the Webpage are 100% secure. The bank details are sent to our servers in encrypted form via SSL (Secure Socket Layer) protocol and transmitted in a completely secure environment to our bank without registering bank details at any time.
- The Buyer must enter their bank details and then validate the purchase.
- The Buyer will simultaneously receive a response from the bank, indicating whether their authentication request has been accepted or rejected. If the authentication is accepted, their account will be charged. In the event not all products selected are available, the Company will contact the Buyer via e-mail and/or telephone to notify them and to proceed with partial or total refund or change of item.
- If the Buyer wishes to return to the Website's home page, they must click on the 'To home page' option. The secured connection will close and the buyer will return to the Website.
- Once the payment has been made and the purchase process has been completed, the Buyer will receive a first e-mail, informing them that their purchase request has been received with the details of the purchase made.
- Then, the Buyer will receive a second e-mail informing that the order has been sent (if payment and product availability have been fully confirmed).
- The Buyer may track the order through the link provided in the e-mail or by accessing the 'Orders' section at the top of the Webpage.
- The order will only be valid once the system has accepted the payment through the central network of bank card authorizations. Financial expenses (any bank charges related to exchange rates, bank charges for payment transactions made outside the territory of issuance of the bank card and other banking commissions) that may result from the bank card payments will be borne by the Buyer and will be detailed in the price breakdown.
- If the payment by a bank transfer is the method chosen, you must make a transfer or cash deposit to the given account number, indicating the order reference in the subject line, as detailed in the purchase confirmation. It is very important that you indicate to your bank that the bank charges for the transfer will be paid by you.
- The order will not be considered as made and therefore the item(s) will not be sent, until we have confirmation of the transfer/deposit from our bank.
- The transfer/deposit is made to a Spanish account number and all possible exchange and/or bank fees shall be at your cost.
- For bank transfers made outside Spain, it is very important that when ordering the transfer, you always inform your bank to charge the commission at source. Otherwise, the Company may block the shipment until the full amount of the purchase is received.
- Receipt of the order:
- 'Click & Collect' (Store Pickup) option:
- In this case, the Buyer will receive an e-mail confirmation once the payment has been successfully made according to the selected payment method.
- If 100% of the purchase is paid through the Website, the product will be saved in the selected store for a maximum period of two (2) months.
- However, if the Buyer pays 20% of the total value of the purchase price to reserve the product, when picking up the purchase they must pay the outstanding amount since, otherwise, it will not be handed. The product will be reserved for pickup at the selected store for thirty (30) calendar days from approval of the payment through the Website.
- In the case of the Click & Collect service with 100% payment of the product, the right of withdrawal period will expire after thirty (30) calendar days from the date on which the pick-up service is formalised online.
- In the case of the 20% payment method, as it is an online product reservation, the right of withdrawal does not apply in this process.
- In both cases, if the purchase is not picked up within the specified period, the Company reserves the right to sell again the products purchased by the Buyer.
- Furthermore, in the case of payment of 100% of the price, after the collection period has expired, the Company may apply - except for justified reasons - a deposit charge for the product consisting of 30 percent of the price paid, the remaining price being refunded to the buyer by means of the same payment system.
- In the case of reservation of the product by payment of 20 percent, The Company will reimburse The Buyer the totality of the amounts paid for the reservation of the product if the product has not been collected within the indicated period.
- Courier delivery option:
- In this case, our courier service(s) will deliver the order at the delivery address indicated at the time of purchase. In no case will shipments be made to hotels, PO boxes or Army Forces Postal Offices (such as BFPOs). The Buyer can always track the shipment of their order through the Website. The Webpage does not offer a service for selecting a preferred delivery time. Therefore, if the Buyer does not receive any communication from our courier service, they may contact them to agree to any changes. In most cases, if you are absent during the first delivery attempt at the delivery address, the courier service will deposit your order at the nearest post office and will send a SMS or an email to the given phone number or email address offering delivery alternatives. Note that in this case you will have a certain number of days (depending on the carrier) to pick up the order.
- The estimated order delivery period varies by destination always considering business days and are not affected by local or national holidays or other events:
- Spain: For shipments to Spain, your order will be delivered by urgent courier within two to four (2-4) working days in the Peninsula, four to five (4-5) working days in the Balearic Islands. The shipping costs will appear in the final summary of the purchase, before confirming of the order, depending on the shipping address.
- France - Portugal: Delivery will be made by courier within approximately four to five (4-5) working days. The shipping costs will appear in the final summary of the purchase, before confirming of the order.
- Germany - Austria - Belgium - Italy - Luxemburg - Netherlands - United Kingdom: Delivery will be made by courier with an approximate delivery time of four to six (4-6) working days. The shipping costs will appear in the final summary of the purchase, before confirming of the order.
- Bulgaria - Denmark - Slovakia - Slovenia - Estonia - Greece - Ireland - Latvia - Lithuania - Poland - Czech Republic - Finland - Hungary - Sweden - Romania: Delivery will be made by courier within approximately six to eight (6-8) working days. The shipping costs will appear in the final summary of the purchase, before confirming of the order.
- Other countries: The order will be shipped as long as the dimensions of the package are not a restriction. The delivery time will vary depending on the destination country (delivery will take approximately seven to fifteen (7-15) working days). In these destinations, the customs systems of each country will apply the corresponding tax charges. Transport costs vary depending on the destination, the amount of the purchase and the volume/weight of the goods. The amount will appear as a final summary in the end of the purchase, after confirmation of the order. In these cases, if a purchase cannot be sent to these destinations (for reasons of volume, postage, additional taxes) and the payment has been made correctly, you will be notified by e-mail and/or telephone and you will be immediately refunded the amount paid and the order will be cancelled.
- NOTE: Deliveries will not be made to certain destinations, including but not limited to the United Kingdom and its territories such as the Channel Islands and Isle of Man (UK), as well as the Azores, Madeira (Portugal), Canary Islands, Ceuta, Melilla (Spain). In this case, if the payment has been made correctly, you will be notified by e-mail and/or telephone and you will be immediately refunded with the amount paid and the order will be cancelled. To check if products are shipped to your country, please contact the customer service by the e-mail viladomat@viladomat.com.
- 'Click & Collect' (Store Pickup) option:
- Delivery times depend on the items requested, as well as the shipping address, and will be provided as an estimation during the purchase process.
5. EXCHANGE / REFUND AND WARRANTY POLICY
- The products offered through the Website are original products of the offered brands, with manufacturer's guarantee and without any defect, all of them complying with the legally established guarantee periods.
- Defects or damage due to incorrect use or handling of the equipment once purchased and wear and tear caused by normal use thereof, are not included in this warranty.
- Decrease in the functionality of items, due to misconception thereof, are also excluded from this warranty coverage.
- If you would like to make use of your warranty right, please contact our customer service by email at viladomat@viladomat.com in order to inform you on how to proceed. Once the manufacturing defect has been verified and in accordance with the manufacturer's instructions, we will refund the purchase price or replace the item. Transport costs will be refunded only in case of acceptance of the warranty.
- We recommend that you keep the original packing and transport packaging until you are sure you want to keep the goods. Without them we cannot accept their return. Please note that the transport costs will be reimbursed only if the goods differ in any way from the products advertised. Once receiving your return and having checked the product's condition, we will proceed with the refund or product exchange according to your instructions.
- For any exchange and/or return of a product, the Buyer must fill in and send the withdrawal form found in the 'Help Centre' section or by clicking on the 'User' icon and selecting the order from 'My Orders', clicking on 'I want to exchange or return an article'. The Buyer must indicate whether he/she wants to return the order for a refund or exchange the size, colour, or article for another one. Once all fields are completed, the Buyer must submit the form. The products must be returned in perfect condition, with the original packaging of the brand and with the original label intact. Once the form has been received by the Company, the Customer Service Department will contact the Buyer by e-mail to indicate the return number and the return address, as this may vary depending on the country of destination of the purchase.
- The Company reserves the right to reply to the form sent by the Buyer within forty-eight (48) working hours. Notwithstanding the foregoing, the Company warns the Buyer that this period may be longer if there are reasons and circumstances that prevent the Company from replying immediately, such as, for example, the amount of work that the Company may have during peak seasons, among others. The deadline for the exchange and/or return of products through the withdrawal form is fourteen (14) calendar days from the day on which the Buyer or a third party indicated by the Buyer, other than the carrier, acquired material possession of the goods or, in the event that different goods of the order are delivered separately, fourteen (14) calendar days from the day on which the Buyer or a third party indicated by the Buyer, other than the carrier, acquired material possession of the last of these goods. The Buyer must deliver the returned product to the carrier of his choice within 14 calendar days from the date of the Company's reply, indicating the address and return number.
- The deadline for the exchange and/or return of products in Andorra shops is thirty (30) calendar days from the day following the date of purchase.
- The Buyer must show the receipt of the purchase at the moment of the return. Products must be returned in the original packaging in the same condition as they were delivered, in perfect condition, unused and with all the original components and labels. This section, however, is only valid for items collected in our shops in Andorra, such as Click & Collect purchases and purchases delivered to your home in Andorra. It does not apply to products purchased through the website and delivered to countries other than Andorra.
- When the Company receives the returned product and verifies that it accomplishes with the conditions indicated below, the Buyer will be reimbursed the amount paid in the purchase process, using the same means of payment, and within a maximum period of fourteen (14) calendar days from receipt of the returned product. To this end, the Company shall retain the amount to be refunded until it receives the product(s).
- No returns will be accepted after the deadline set out above (within 14 calendar days from the date of the Company's reply).
- We do not accept returns of safety equipment such as climbing, mountaineering, cycling, snow sports and perishable items, underwear, swimwear, face masks or customised products to the customer's instructions such as printed shirts.
- The direct costs of returning the product will be borne by the Buyer except in the cases of shipping error, damaged order or products in poor condition. In such specific cases, the return costs will be borne by the Company provided the return is carried out in accordance with the return instructions indicated in these Terms and Conditions.
- In the event that the Company detects any kind of manipulation of the product other than the necessary ones in order to check its nature, characteristics or functioning or any types of damages to the returned product, it will inform about this, and the Company reserves the right either to return the product in question to the Buyer by cash on delivery, assuming the latter the corresponding shipping costs, or to accept the return of the product with the appropriate deduction from the price depending on the kind of significant damage to the product or its packaging, which will be communicated to the customer in advance.
- As for products that must be opened in order to verify their correct operation, the Company will require that the particular product be in perfect condition having all its elements, accessories and packaging, and no refund will be made if these requirements are not met.
- Products must be returned and packed with the original packaging as received, in perfect condition, unused and with all components (for example, if the package was opened to examine the product you must re-package it without damaging the product). If you have not kept the original protective packaging with which it was delivered, you must purchase a package of similar characteristics. European copyright laws as well as Royal Legislative Decree 1/2007 of 16 November approving the General Law for the Protection of Consumers and Users (LGDCU), prohibit the return of software, media, CDs and other sealed type software where the packaging has been opened or the product has been registered unless the product is defective. This includes, for example, the software CDs included in the GPS, and any software that has been sealed.
- The Company may not be held responsible for the packages that have not been delivered to us.
- Likewise, the stores in Andorra will not accept returns or exchanges of products purchased through the Website and delivered in a country other than Andorra. In these cases, returns and exchanges must be made in accordance with the procedure indicated above.
6. PRODUCTS
The products and services offered on the Website are grouped into:
- Sale of a wide variety of products related to sport activities which will be listed, in each case, in the details of the products offered at any given time through the Website.
- Products offered through the Website, subject to registration by the Buyer on the website www.viladomat.com (hereinafter the 'Product' or the 'Products').
- Booking services for the rental of sport equipment and its subsequent collection at one of the Company's stores indicated by the Buyer (hereinafter, the 'Service').
All the Products sold through our Website are authentic and purchased, in all cases, through the official channels of the brands we sell.
All Product orders are subject to availability. In this sense, if there are difficulties in the supply of Products or if there are no items in stock at that time, the Company will contact the Buyer to inform him of the new delivery time, and the Buyer may choose to maintain the order or to receive a refund of the total amount paid. For further information on the availability of the Products, see section eight (8) of this document.
For orders of more than one Product, where one of them is not in stock, the Company will contact the Customer to agree one single shipment, separate shipments, or reimbursement of the order using the same payment method used by the Buyer.
In any case, the Company reserves the right at any time to remove Products from the Website and to remove or modify any material or content of the Website. The Company undertakes to do its best to always process all orders, however, there may be exceptional circumstances that may require it to refuse to process an order after it has been submitted.
The Company will not be liable to the Buyer or any third party for removing one or more Products from the Website, whether or not such Product has been sold, for removing or modifying any material or content of the Website or, if applicable, for refusing to process an order once confirmation has been sent to the Company.
The Buyer can also cancel his order if it has not left yet the Company's warehouses. To cancel an order, the Buyer must send an e-mail to the following e-mail address: viladomat@viladomat.com.
If the Buyer has already received the order confirmation, and the order is therefore already in transit, the Buyer may exercise his right of withdrawal in accordance with the provisions of section five (5) of these Terms and Conditions.
7. PRICES
The prices displayed on our Website are shown including the corresponding taxes and duties for member countries of the European Union. For the rest of the countries, prices are shown excluding taxes and duties corresponding to the country of destination, which must be paid by the Customer at destination upon delivery.
In all cases, prices are displayed excluding shipping costs. The shipping costs for each order are calculated according to the weight and dimensions of the purchase, as well as the delivery address. The shipping cost will appear in the end summary of the purchase before the confirmation of the order.
The retail price of the items will always be shown at the moment where the Buyer has completed the shopping cart, and will be informed about the final price of his purchase before confirming the payment.
In any case, the shipping costs will be recalculated at each step of the purchase process on the Website, and will always appear in the shopping cart, clearly and differentiated from the price of the Products or Services.
The Buyer will be informed of the final price of his purchase, including shipping costs, before the payment is validated. For shipments to the European Union, any orders over sixty (60) Euros will benefit from free shipping (except for Corsica and Sicily).
The Company reserves the right to change the selling prices, which may be revised and modified as conditions require at any time without prior notice.
At the Company we strive to provide the information on the Website accurately and without typographical or photographic errors but if an error of this type occurs, at all times beyond our will, we will immediately proceed with correction thereof. In the event of a typographical error in any of the prices, descriptions, features, photographs of products, if a Buyer has made the decision to purchase the product based on those error(s), the Company will contact him notifying the error and thus cancelling the purchase without any cost to the Buyer.
8. AVAILABILITY OF PRODUCTS AND CUSTOMER SERVICE
All Products are subject to availability.
Once the purchase request is made, the Company will provide you with the total or partial acceptance and, consequently, the confirmation or termination of the purchase contract as a result of your order.
In case of a total or partial non-execution of the contract for reasons ascribable to the Company because all or some of the contracted items are not in stock and it is not possible to obtain new stock of the product in question, the Company will inform you of this lack of availability and you will be reimbursed the amounts that you have paid under the contract, without any liability for the Company. These communications will be made by telephone and/or e-mail.
In case of acceptance of your order, the Company undertakes to notify you of the status of the order, by e-mail or by telephone and/or to update the order in the Buyer's personal space which can be accessed by clicking on 'My account'.
The electronic document formalizing the purchase contract will be archived by the Company and will be available via the link 'My Account' / 'Orders'.

9. RESPONSABILITIES
The Company will ensure that the contents, data or information regarding the Products and Services offered on the Website are reliable, truthful, and accurate, and shall be responsible for the prices and characteristics advertised. However, if at any time there is a typographical error in any of the prices, descriptions, characteristics, images of the products, totally beyond our control, and which has led the Buyer to make a purchase decision based on said error(s), the Company will contact the Buyer to inform him/her of the error and thus cancel his/her purchase without any cost from the Buyer.
All images shown on our platform are not contractual and may vary depending on the manufacturer, although we always ensure that the descriptions of the Products are as true to reality as possible.
However, the Company will not be responsible for any information that had been introduced, displayed or modified by third parties outside the Company on the Website. The Company will not be responsible for those damages caused to the Buyer by the use of the Internet network (such as viruses, among others).
The Company and the Buyers shall be liable for any offenses committed personally, holding the other party harmless against any error, fault or negligence not attributable to it, and any damage that may arise from such offenses or errors shall be attributable to the other contracting party.
The Company and the Buyers undertake to comply with their legal and contractual obligations generated under this contract. If a party fails to comply with any of its obligations or intends to hinder compliance by the other party of its own obligations, this will give the other party the right to claim compensation for damages caused, both for consequential damages as well as for lost profit according to current legislation.
The Company shall not be held liable in case of unavailability of the Products or inability to provide the service for reasons beyond its control. The Company shall likewise not be held liable in case of impossibility of delivery of the Products due to force majeure, theft or loss, error in the order or data provided by the Buyer. However, in such cases, the Company will immediately contact the Buyer in order to find the best solution to the case.
For the purposes of these General Sales Conditions, the following shall be understood as force majeure, including but not limited to: (i) events that are impossible to foresee or which, if foreseen, are unavoidable; (ii) damage caused by third parties outside the Company that affect the quality of the Company's products and services and that are not attributable to it; (iii) strikes or labour disputes; (iv) epidemics or pandemics.
Provided that the cases referred to above are beyond the control and due diligence of the Company, there shall be no compensation from the Company to the Buyer for loss of profit, damage or loss.
If Should any of these General Sales Conditions be declared null and void by a court of law or any other competent authorities decision, the remaining terms and conditions shall remain in force and shall not be affected by such declaration of nullity.
10. REQUEST FOR RENTAL, WINTER/SUMMER EQUIPMENT
The reservation of rental equipment through the Company's Website for pick-up at one of the Company's stores selected by the Buyer, implies the acceptance of the general conditions listed below. The General Rental Conditions may be subject to change, but the conditions that apply are the conditions in force on the Website at the date of reservation. The Buyer declares to be of legal age and to have the legal capacity to make a rental reservation on the Website. The Buyer undertakes to comply with these General Rental Terms and Conditions.
- RENTED EQUIPMENT
- The Company undertakes to offer at least a similar category to the range selected.
- No reservation may be made with one calendar day prior to the requested date.
- RENTAL PRICES
- The rental price is determined by the category of the equipment reserved and the rental period chosen according to our price list. Our prices include taxes in effect in Andorra, country where the service is provided.
- PAYMENT METHOD
- The payment of the reservation will be made directly online by clicking on the 'pay now' button by bank card (Visa, Eurocard or Mastercard) 100% of the amount must be made.
- During the payment transaction, you are automatically connected to the server’s payment gateway management centre. The bank details, protected with encryption, do not transit through the Company's systems and, therefore, are not in possession of the Company.
- Only VISA, EUROCARD or MASTERCARD cards issued within the approved international banking networks are accepted. The booking will only be valid once the system has accepted the payment through the central bank card authorisation network. In case the payment is rejected, the booking will not be registered.
- Financial costs (bank charges related to exchange rates, bank commission for payment transactions made outside the territory where the card is issued and other bank commissions) that may result from payments by bank card will be borne by the Buyer. These expenses correspond to any charges perceived solely by the banking establishment of the customer for using their bank card.
- CONTRACT COMMITMENT
- The reservation is considered as finished and is effective upon acceptance of the payment by the bank and the receipt by the Buyer of a confirmation e-mail of the reservation. The Buyer must submit this confirmation, either printed on paper or in electronic format, at the Company's selected rental store.
- DELIVERY AND RETURN OF RENTED EQUIPMENT – RENTAL PERIOD
- The rental starts from the moment the Buyer picks up the equipment at the selected store until and including the day of return, according to the duration indicated in the confirmation of reservation.
- Equipment can be picked up the day before the reservation after 3:30 pm and returned at the end of the last day of the rental.
- Any return of equipment after 10:00 AM the day specified rental ending date in the confirmation, will entail the charge of an additional day of rental at the rate indicated at the store.
- The Buyer accepts the equipment as it is delivered and is responsible for the proper use and maintenance of it during the rental period. Normal use of the material is expected. Excessive or unusual use will be valued and charged at the end of period if necessary. The equipment rented is under the sole responsibility of the Buyer who, therefore, will use it in all circumstances with good judgment and prudence.
- The pick-up of the rented equipment is under the charge of the person who made the reservation and should be picked up at the store selected when making the reservation. If said equipment is picked up late, the Buyer must notify the selected store as soon as possible. If notice is given, the equipment will be reserved for 24 hours. Once this time has elapsed, if the Buyer has not collected the equipment, this will be made available at the store without any compensation to the Buyer.
- The equipment must be returned to the store where it was picked up. If the equipment is not returned, for whatever reason, the store has the right to charge the full value of new equipment at the retail price. The Buyer may be provided with warranty service for the equipment at the store, which will allow the Buyer to benefit from lower prices in case of problems with the equipment subject to rent.
- USE OF THE RENTED EQUIPMENT
- The rented equipment will be for the exclusive use of the person who has reserved it without being able to sublease or lend it for free. The Buyer is solely responsible for judging his ability to use the rented equipment.
- The Buyer assures that he is qualified to use the rented equipment and undertakes to handle it prudently without danger to third parties, in accordance with the laws in force. No guarantee covers any defect in the adaptation of the rented equipment to the Buyer's specific needs or other regulations carried out by the Company's shop in accordance with the international rule ISO 11088 (in the case of regulation of ski bindings).
- All the material we offer is rented in good condition. The Buyer accepts it as it is delivered and must return it in the same condition. The Buyer is responsible for the proper use and maintenance of the equipment during the rental period. Normal use of the equipment is expected, and excessive or unusual use will be assessed and charged at the end of the period if necessary.
- Rental equipment is numbered and will have to be returned with the same numbers. Any kind of damage, whatever the cause, will entail the payment directly at the store of replacement or repair cost, with the maximum limit of the value of a new piece of equipment. The Buyer has the possibility to purchase the rental equipment warranty service offered by the Company. This warranty service will allow the Buyer to benefit from lower prices in case of problems with the equipment. The prices of the warranty service are available at the selected Company store.
- AVAILABILITY OF THE PROPOSED RENTAL EQUIPMENT
- The Company shall not be responsible for delays in the pick-up of the equipment for reasons beyond its control, such as cases of accident, delay in the previous delivery, modification of regulations or force majeure.
- In any case, the Company will make any effort to offer the Buyer equipment with equal or superior quality, depending on the equipment in stock, respecting the price fixed.
- CANCELLATION CONDITIONS AND RIGHT OF WITHDRAWAL
- CANCELATION BEFORE DELIVERY OF THE EQUIPMENT
- The Buyer agrees that, as this is the provision of a Service and in accordance with the provisions of Article 103 a) of Legislative Royal Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, they will not have right to cancel the service once the order has been confirmed.
- However, the Company allows cancellations up to 24 HOURS prior to the start date of the rental, always being within the working hours of business days being understood as Monday to Friday from 9:00 am to 6:00 pm; Saturdays, Sundays and holidays are off this period. For this purpose, the Buyer shall inform the Company by email to the address viladomat@viladomat.com . In this case, the Buyer will receive a full refund of the reservation through the same payment method used for the transaction.
- If the Buyer decides to cancel the reservation without respecting 24 HOURS business period prior to the date established for the start of the rent and, in any case, before the day indicated for the start of the rental, the Buyer will have the right to receive a refund of 50% of the payment advanced.
- CANCELATION BEFORE DELIVERY OF THE EQUIPMENT
- CANCELLATION AFTER THE HANDING OF THE EQUIPMENT
- In case of force majeure (illness, accident...) during the rental period, the conditions remain in force. Only the equipment rented by the person concerned may be returned and fifty percent (50%) of the amount of the days not used will be deducted (with presentation of a medical certificate and proof of return of the equipment to the store). The refund will be made by the same means of payment used at the time of the reservation.
11. SITE ACCESS LICENSE
The Company grants a limited license to access and use the Website for the purpose of viewing the products offered and making the desired purchases. In no case does this confer the right to load or modify the contents of the Website without the express authorization of the Company.

All content of this Webpage, including text, brands, distinctive logos, images, graphics and designs are owned by the Company or, if applicable, by the Parent company and are protected by current legislation regarding Intellectual and Industrial Property.

The Group Companies are subject to the cooperation of the Buyer to keep your data duly updated. In PIRINEU PORT’s case, these General Sales Conditions are subject to Spanish legislation and to the Courts and Tribunals of the domicile of PIRINEU PORT or of the domicile of the Consumer, at the choice of the latter in accordance with article 52.3 of Law 1/2000, of 7 January, on Civil Proceedings.
